When does Benedictโs Law come into force?
Benedict’s Law is expected to come into force in September 2026 for schools in England. It will require schools to implement robust allergy management arrangements, ensure staff receive appropriate allergy and anaphylaxis training, and maintain effective procedures for preventing and responding to allergy incidents.
Which schools must comply?
From September 2026, all schools in England will be required to comply with Benedict’s Law and the associated statutory allergy guidance, including maintained schools, academies, free schools, independent schools, special schools and alternative provision settings.
Who takes ultimate responsibility for Benedictโs Law compliance?
Ultimate responsibility for compliance with Benedictโs Law rests with the school’s governing body, academy trust, or proprietor, depending on the type of school. They are responsible for ensuring appropriate allergy policies, procedures, training, and emergency arrangements are in place.
Day-to-day implementation may be delegated to the headteacher and staff, but accountability remains with the governing body, trust, or proprietor.
Will compliance be inspected?
Yes. Compliance with Benedictโs Law is expected to be monitored through existing school inspection and assurance processes. This is likely to include consideration by Ofsted during inspections, as well as oversight by governing bodies, academy trusts, and local authorities where applicable.
While inspectors may not conduct a standalone โBenedictโs Law inspectionโ, schools will be expected to demonstrate that they have appropriate allergy policies, training, risk management arrangements, and emergency procedures in place.
Our lunchtime supervisors and caretakers work highly irregular, part-time hours. How can we get them trained without paying them overtime to come in on an INSET day?
Benedictโs Law (Allergy Awareness Training) is an eLearning course so staff can complete it at a time that suits their normal working pattern without needing to attend an INSET day. The course can be started, paused, and resumed as needed, allowing lunchtime supervisors, caretakers, and other part-time staff to fit the training around their existing hours while still ensuring the school can evidence compliance.
Our staff already do mandatory First Aid at Work/Paediatric First Aid training that covers anaphylaxis. Why do we need to buy a specific Benedict’s Law course if we are technically already “covered”?
First Aid at Work and Paediatric First Aid training are essential because they focus primarily on recognising and responding to medical emergencies.
As well as emergency preparation, Benedict’s Law requires a whole-school approach to allergy management, including prevention, risk assessment, individual healthcare plans, communication with parents, food management, record-keeping, emergency procedures, and staff responsibilities.
Our Benedict’s Law allergy awareness course helps schools demonstrate that staff understand the specific policies, procedures, and legal expectations associated with allergy management in an educational setting. The course complements first aid training by ensuring staff know how to prevent incidents as well as respond to them.
